If you have purchased HDD suspension assemblies, or products containing them, between January 1, 2003 and April 30, 2016, you may be a member of the proposed class.

Case Contacts
HDD suspension assemblies are incorporated into hard disk drives, which are found in electronic devices such as computers, gaming consoles, video recorders, and stand-alone storage devices. This class action alleges that certain manufacturers of HDD suspension assemblies engaged in an illegal cartel to fix prices of HDD suspension assemblies in Canada.
The defendants’ conduct is alleged to have inflated the price of HDD suspension assemblies, and of products like computers, laptops, and gaming consoles, for consumers and businesses across Canada. The class actions seek recovery of these overcharges on behalf of purchasers.
Case History
On July 30, 2019, our lawyers issued a Statement of Claim on behalf of all persons and entities in Canada who purchased HDD suspension assemblies, or products containing HDD suspension assemblies, during the class period.
Separate actions were commenced in British Columbia and in Québec. Class Counsel is working to prosecute these class actions on a national basis.
The Ontario and Québec Actions have been conditionally stayed pending the final outcome of the certification application in the BC Action.
Certification
The BC Action was certified by Order of Justice Coval on October 6, 2022. The defendants appealed Justice Coval’s certification decision to the British Columbia Court of Appeal, which upheld Justice Coval’s decision. The defendants sought and were granted leave to appeal the certification order to the Supreme Court of Canada. Further information will be posted as these matters proceed.
