This is a consumer class action alleging that Intuit Canada ULC and Intuit Inc. (“Intuit”), has unlawfully designed, developed, marketed, and sold a defective personal Canadian income tax preparation software product known as TurboTax. The claim specifically concerns the allegation that for the 2020 to 2024 taxation years, TurboTax software automatically and incorrectly applied the Ontario Child Care Tax Credit (also referred to as the Ontario Childcare Access and Relief from Expenses (“CARE”) tax credit) to tax returns on behalf of class members who are ineligible to receive it. Class members have received Notices of Reassessment for those taxation years from the Canada Revenue Agency (“CRA”) resulting in liability to class members for unpaid taxes, penalties and interest.

Case Overview

The claim alleges that Intuit’s TurboTax income tax preparation software was negligently designed, marketed and sold in Ontario and that it contains an error that fails to properly calculate and apply the CARE tax credit for spouses or partners who file coupled income tax returns through Intuit’s TurboTax software.

The claim also alleges that Intuit has breached its contractual commitments to class members and that it has otherwise failed to comply with the terms of TurboTax licensing agreements. 

Finally the claim alleges that the defendants have breached the Ontario Consumer Protection Act. The claim alleges that Intuit provided a tax preparation software that does not accurately or competently prepare a personal income tax filing for class members.

The claim further alleges that Intuit has failed to compensate class members for their error as is required under the terms of their user licensing agreements.

As a result, class members are alleged to have suffered losses and damages.

Case Status

The Statement of Claim was issued on May 5, 2025.

The Certification Motion has not yet been scheduled. Further information will be posted as this matter proceeds.
