If your Personal Health Information (“PHI”) was accessed by the defendant, Maria Abou Taka, while she was an employee, student and/or agent of LHSC, but was not a member of your personal health care team, you may be a member of the proposed class.

Class members include, but are not limited to, individuals that received a privacy breach notice letter from LHSC in or about February of 2025 advising them that their PHI had been inappropriately accessed by an employee.

This is a privacy law class action alleging that the personal health information of class members was breached through the intentional actions of an employee at Southwestern Ontario’s largest hospital organization, as a result of the hospital’s negligence. 

 

Case Overview

The claim alleges that the Personal Health Information (“PHI”) of hundreds of patients at the London Health Sciences Centre and London Health Sciences Centre Research Inc. (d/b/a London Health Sciences Centre Research Institute) (collectively, “LHSC”) was breached through the intentional acts of their employee, the defendant Maria Abou Taka. The claim alleges that Ms. Abou Taka committed a long campaign of violating the PHI of people she knew and notable members of the London, ON community, while not a member of their healthcare team.

The claim further alleges that the LHSC defendants breached their duties under the law to maintain confidentiality of class members PHI. It is also alleged that the LHSC defendants grossly failed to have in place proper systems to protect class members’ PHI, and failed to complete a full investigation once Ms. Abou Taka’s actions became known to them.

As a result, the PHI of hundreds of class members (or more to be uncovered) are alleged to have been compromised.

 

Case Status

The Statement of Claim was issued on May 9, 2025.

The Certification Motion has not yet been scheduled. Further information will be posted as this matter proceeds.
