This class action claims that the Canadian National Railway Company (CN) charged certain unlawful fuel surcharge tariffs on customers who purchased CN’s rail freight shipping services. 

The plaintiff alleges that fuel surcharge tariffs identified as “CN 7400” and “CN 7401” are unlawful as they result in CN recovering more than their incremental increase in fuel costs. 

The class action seeks damages and other remedies on behalf of CN customers who paid such surcharges.

Case Status

This matter has been filed in London, Ontario. The Certification Motion has not yet been scheduled.  Further information will be posted as this matter proceeds.
