Case Information

This class action alleged a long-standing anticompetitive conduct by the so-called “German Five” automakers – Audi, BMW, Mercedes Benz, Porsche, and Volkswagen.

Since as early as 1990, the defendants are alleged to have established a series of organized “working groups” to collude on virtually all aspects of automotive design, development, manufacturing, and marketing.

The plaintiff claimed that this conduct resulted in slowed vehicle innovation and reduced price competition amongst the German automakers. The class action sought corresponding damages on behalf of Canadian purchasers.
