This action involves Google’s alleged collection of personal information from Canadians using Google services including visiting websites that host Google Ads and Google Analytics. It alleges that Google trespasses on class members’ devices by sending instructional code to their computers, tablets, or smartphones when using Google services or when visiting host sites. That code allegedly executes instructions that cause users’ computers or smartphones to secretly compile and send users’ personal information to Google, which can include, among other personal details, their name, gender, and location, the terms they’ve typed into Google, their IP address, the device they’re using, and the site they’re visiting. This results in a depiction that allegedly includes sensitive personal details such as marital and parental status, income bracket, and sexual orientation, among others.

Google allegedly uses this personal information to generate profiles of almost all internet users so they can target advertising, without the users’ knowledge or consent. Google’s alleged actions violate Canadian privacy, consumer and competition laws.

Case Status

This matter has been filed in Toronto, Ontario. At this time, the litigation is primarily proceeding out of British Columbia and Québec, and the Ontario Action is temporarily stayed.

The Québec Action was authorized to proceed as a class proceeding by Justice Bisson on June 26, 2022.

The certification motion in the BC Action has not yet been scheduled.
