This class action was brought on behalf of all Canadians who purchased a lawnmower containing a gas combustible engine of 30 horsepower or less, that was designed, manufactured and/or sold by any of the defendant companies between January 1, 1994 and December 31, 2012. It alleged that the defendants participated in an unlawful conspiracy to raise, fix, maintain or stabilize the price of lawnmowers in Canada, unduly lessen competition, and/or to conduct business contrary to the Competition Act and the Consumer Packaging and Labelling Act.

Our lawyers led a national consortium that sought to recover the overcharge that class members paid for lawnmowers during the period of January 1, 1994 to December 31, 2012.

 
 

Settlement

This case has been fully resolved through Court-approved settlement agreements reached with the defendants on behalf of the class totaling $7,535,000.

A four month long notice and claims process was undertaken.  That claims process concluded on May 22, 2019. Individuals and businesses who made successful claims for lawnmowers purchased for their own use received their cheques in May, 2020. Upstream purchasers of lawnmowers for resale who made successful claims received their cheques in July, 2020. The settlement claims website can be found here.
